These Terms and Conditions (the “Terms”) govern your access to and use of the website located at achievia.mv and any of its subdomains, pages and content (collectively, the “Website”). The Website is owned and operated by Achievia Pvt Ltd, a private limited company incorporated in the Republic of the Maldives and trading as “Achievia Consultancy” (“Achievia”, “we”, “us” or “our”).

These Terms and Conditions (the “Terms”) govern your access to and use of the website located at achievia.mv and any of its subdomains, pages and content (collectively, the “Website”). The Website is owned and operated by Achievia Pvt Ltd, a private limited company incorporated in the Republic of the Maldives and trading as “Achievia Consultancy” (“Achievia”, “we”, “us” or “our”).

By accessing, browsing or using the Website, you (“you”, “your” or the “User”) confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you must stop using the Website immediately.

7. Enquiries, Submissions and Forms

Where the Website allows you to submit an enquiry, contact request, subscription or other information, you agree to provide accurate, current and complete information. Communications submitted through the
Website’s contact forms are for general enquiries only; please do not send confidential, privileged or sensitive information through the Website, as the security of such transmissions cannot be guaranteed until a formal engagement and appropriate confidentiality arrangements are in place.

Any feedback, suggestions or ideas you voluntarily provide to us regarding the Website may be used by us without any obligation or compensation to you

1. Definitions

“Content” means all text, articles, guides, images, graphics, logos, icons, audio, video, data, layouts, designs and other materials made available on the Website.

“Portfolio Items” means any client work, project, corporate profile, business plan, case study, sample, deliverable or related materials displayed on the Website under sections such as “Projects”, “Our Work” or similar.

“Articles” means the informational, how-to, explainer and news content published on the Website (including under the “News” or blog section).

8. Third-Party Links, Partners and Materials

The Website may contain links to third-party websites, tools, or references to affiliated partners and collaborators. Such links and references are provided for convenience only. We do not control, endorse, or assume responsibility for the content, products, services, privacy practices or availability of any third-party website or partner. Your dealings with any third party are solely between you and that third party, and are subject to that third party’s own terms and policies.

9. Privacy and Cookies

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use and protect personal data in accordance with applicable data-protection law of the Republic of the Maldives, including the Personal Data Protection Act (Law No. 23/2024) where and to the extent it applies. 2. About Achievia and Eligibility

Achievia is a multi-disciplinary business consultancy offering services that may include business planning, financial management, risk management, compliance (including AML/CFT), marketing, training and related advisory services. The Website is an informational and marketing platform and, unless expressly stated in a signed engagement, does not itself constitute the provision of professional services.

By using the Website you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into a binding agreement. If you use the Website on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

3. Use of the Website

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your own lawful, personal or internal business purposes. You agree that you will not:

  • use the Website in any way that breaches any applicable law or regulation of the Republic of the Maldives or of any other jurisdiction from which you access it;
  • use the Website for any fraudulent, unlawful, defamatory, harassing, obscene or otherwise objectionable purpose;
  • attempt to gain unauthorised access to, interfere with, damage or disrupt the Website, its servers, or any connected network, including by introducing viruses, malware or other harmful code;
  • use any robot, spider, scraper, or other automated means to access, harvest or copy Content or Portfolio Items without our prior written consent;
  • reproduce, duplicate, copy, resell or exploit any part of the Website except as expressly permitted by these Terms; or
  • remove, obscure or alter any copyright, trademark or other proprietary notices displayed on the Website.

We reserve the right to restrict, suspend or terminate your access to the Website at any time, without notice, where we reasonably believe you have breached these Terms.

4. Intellectual Property Rights

Except for Portfolio Items (addressed in Section 5) and any third-party materials, all Content on the Website — including the Achievia name, logo, brand identity, text, Articles, graphics, layout and design — is owned by, or licensed to, Achievia and is protected by copyright, trademark and other intellectual property laws of the Republic of the Maldives and applicable international treaties, including the Berne Convention for the Protection of Literary and Artistic Works.

You may view, download and print extracts of the Content for your own personal, non-commercial reference only, provided that you do not modify the materials and that you retain all copyright and proprietary notices. You must not otherwise reproduce, republish, distribute, adapt, publicly display or commercially exploit any Content without our prior written permission.

5. Portfolio and Client Works

The Portfolio Items displayed on the Website are showcased with the permission of, and for the purpose of illustrating our experience only. All intellectual property, copyright and other rights in the Portfolio Items belong to the respective clients, project owners or other rightful owners — not to the User and not, except where expressly agreed, to Achievia.

No part of any Portfolio Item may be copied, reproduced, downloaded, republished, distributed, modified, imitated or used for any purpose — whether commercial or non-commercial — without the prior written permission of the relevant rights owner. Nothing on the Website transfers or licenses any right in a Portfolio Item to you.

The names, logos, trademarks and brands of our clients and partners remain the property of their respective owners and are used on the Website for identification and reference purposes only. Their display does not imply any endorsement of you or your activities.

If you are a client or rights owner and believe a Portfolio Item has been displayed in error, or you wish it to be amended or removed, please contact us at [email protected] and we will address your request promptly. Likewise, if you believe any Content on the Website infringes your intellectual property rights, please notify us at the same address with sufficient detail to identify the material, and we will investigate and take appropriate action.

6. Informational Content and Articles — No Professional Advice

The Articles and other informational Content on the Website are provided for general information and educational purposes only. They are not, and must not be relied upon as, professional, legal, financial, accounting, tax, regulatory, compliance, investment or other specialist advice. The Content does not take account of your particular circumstances, objectives or needs.

Laws, regulations, tax rates, thresholds and regulatory requirements in the Maldives and elsewhere change frequently, and Articles may become out of date. While we take reasonable care in preparing our Content, we make no representation or warranty that any Article is current, complete, accurate or applicable to your situation.

You should not act, or refrain from acting, on the basis of any Content without first obtaining appropriate professional advice tailored to your specific circumstances. Your use of, or reliance on, any Content is entirely at your own risk.

No engagement, retainer, fiduciary duty, or client, advisory or professional relationship is created between you and Achievia by reason of your accessing the Website, reading any Article, or contacting us through the Website. A professional relationship with Achievia arises only upon the execution of a separate written engagement or services agreement signed by an authorised representative of Achievia. Any such engagement is governed by its own terms, which prevail over these Terms to the extent of any conflict in respect of that engagement.

10. Disclaimer of Warranties

The Website and all Content are provided on an “as is” and “as available” basis, without any warranties, representations or conditions of any kind, whether express, implied or statutory. To the fullest extent permitted by law, Achievia disclaims all implied warranties, including of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

We do not warrant that the Website will be secure, uninterrupted, timely, or free of viruses or other harmful components, and we are not responsible for any loss or damage arising from a distributed denial-of-service attack, virus, or other technologically harmful material that may affect your equipment or data as a result of your use of the Website.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Achievia, its directors, officers, employees, consultants and agents shall not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your access to, use of, or inability to use the Website or any Content, whether based in contract, tort (including negligence), statute or otherwise, even if we have been advised of the possibility of such loss.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of the Republic of the Maldives.

12. Indemnity

You agree to indemnify and hold harmless Achievia and its directors, officers, employees, consultants and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Website, or your infringement of any intellectual property or other right of Achievia, a client, or any third party (including the unauthorised use or reproduction of any Content or Portfolio Item).

13. Availability and Changes to the Website

We may update, change, suspend or withdraw all or any part of the Website, and any Content, at any time and without notice. We do not guarantee that the Website, or any Content, will always be available or uninterrupted. We may also impose restrictions on access to some or all of the Website.

14. Changes to These Terms

We may revise these Terms from time to time by posting an updated version on the Website with a revised “Last updated” date. The revised Terms take effect from the date of posting, and your continued use of the Website after that date constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter or formation, are governed by and construed in accordance with the laws of the Republic of the Maldives.

The parties shall use reasonable efforts to resolve any dispute amicably through good-faith negotiation. Failing resolution, the dispute shall be subject to the exclusive jurisdiction of the competent courts of the Republic of the Maldives. The parties may alternatively agree in writing to refer the dispute to arbitration administered by the Maldives International Arbitration Centre (MIAC) in accordance with its rules, seated in Malé, Republic of the Maldives.

16. General

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Achievia in relation to your use of the Website and supersede any prior understanding on that subject matter.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to any affiliate or successor.
